Chapter 8 Austerity policies before national and EU courts

Chapter 8 deals with the austerity measures adopted in the countries requesting financial assistance (but also in other countries), which seriously affected social benefits and, in certain cases, infringed on their citizens’ fundamental rights (the right to work, the right to a pension, etc.). It is thus no surprise that they were challenged in various domestic courts, including constitutional courts. In that regard, the chapter provides an overview of the caselaw in the most affected Member States. It also reviews the broad CJEU caselaw on austerity policies adopted in accordance with the Memoranda of Understanding entered into as part of financial assistance packages.
