Analyses of artificial intelligence are often deracinated from AI's basis in software. This chapter delves into the computer science literature to illuminate copyright treatment of software and implications for AI, copyright ownership and fair use. Building on computer science and its relationship with mathematics, engineering and experimental science, the author presents a framework for AI and copyright policy that offers an explanation for the 2021 US Supreme Court decision in Oracle v Google.
