ARTICLE 13 RECOVERY AND REFLECTION PERIOD

This chapter provides commentary on Article 13 of the CoE Convention against Trafficking on the recovery and reflection period, a unique but often controversial instrument of victim protection. It starts with a short introduction, generally providing an overview of the main issues covered by the chapter. It then reviews the drafting history or preparatory work of the provision and provides a comparative analysis of this provision in the context of other international or regional legal instruments focused on human trafficking. The chapter finally discusses issues of interpretation, including the implications of its ‘ban’ on expulsions of victims during the recovery and reflection period.
