ARTICLE 40 RELATIONSHIP WITH OTHER INTERNATIONAL INSTRUMENTS

This chapter provides commentary on Article 40 of the CoE Convention against Trafficking, which has the purpose to regulate the relationship with other international instruments. This provision includes for instance the so called ‘disconnection clause’ concerning the relationship with the European Union and refers to rights relevant for the return of trafficked persons, thereby underlining the principle of of non-refoulement (nonreturn). The chapter begins with a short introduction, generally providing an overview of the main issues covered by the chapter. It then reviews the drafting history or preparatory work of the provision; provides a comparative analysis of this provision in the context of other international or regional legal instruments focused on human trafficking; and finally discusses issues of interpretation.
