Chapter 16 Public services and disability

The present chapter aims to analyze the extent to which the rights of persons with disabilities are protected and promoted under Article 106(2) of the Treaty on the Functioning of the European Union, in particular under the notion of ‘Services of General Economic Interest’ (SGEI) included therein. For these purposes, the chapter focuses on so-called Social Services of General Interest, particularly on those that have an economic nature, namely, Social Services of General Economic Interest. With this aim, the chapter analyzes the relevant law and case law of the European Union (EU), including the Commission’s decisional practice in relation to these services.
