Chapter 10 Disciplinary control of judges in the Netherlands: a vulnerable system

How vulnerable is the Dutch system of disciplinary control of judges to undue political pressure? Although there is no reason to doubt the integrity with which disciplinary control has been exercised in the Netherlands, there are important structural weaknesses in the current system. One major concern is the control that is exercised by court presidents, who play a pivotal role in the disciplinary system, is vulnerable to political interference and lacks adequate procedural safeguards. Reforms are needed to ensure judicial independence.
