Chapter 21 THE TRANSPOSITION OF THE PSD2 INTO FRENCH LAW

The French ordinance of August 9, 2017 transposes the PSD2 into French law, including the new issues while retaining the protective framework established during the transposition of the PSD1. The French legislator did not use many options opened by the PSD2, because most of them had already been exercised during the transposition of the PSD 1. As a result, French law has marginal differences with the European framework concerning the prerequisites. However, some major differences deserve attention essentially that concerning the possibility offered to credit institutions to provide payment services on French territory through payment service agents or that relating to the prior information of the French supervisor in case of a change of shareholders.
